On April 5, 2024, the Second Circuit Court of Appeals affirmed a New York federal court’s dismissal of a plaintiff’s action against his bank, finding that the trial court correctly found that a claim brought under the Fair Credit Billing Act was unsustainable where plaintiff challenged the outcome, rather than the process, of the bank’s investigation of his merchant credit card dispute. Chris Turcotte successfully defended the bank on appeal. Hurckes v. JPMorgan Chase Bank, N.A., 2024 WL 1478575 (2d Cir. April 5, 2024).
